Terms & Conditions
These terms cover the use of this website and the supply of packaging by KG Hospitality Pty Ltd. They are written to be read, not skimmed — the short version is that a quote is an indication, an order is confirmed in writing, and nothing here takes away your rights under Australian Consumer Law.
Last updated: 13 October 2026
These terms are a plain-English draft. Commercial details such as payment terms and quote validity still need to be set by the business and checked before this site goes live.
1. About these terms
By using this website, requesting a quote or placing an order with KG Hospitality Pty Ltd, you accept these terms. If you are ordering on behalf of a business, you confirm you are authorised to do so. If a written agreement is signed for a particular order, that agreement takes priority over anything inconsistent here.
2. Using this website
You may use this site to browse the catalogue and request a quote. Please do not use it in a way that disrupts the service, attempts to access it without permission, or copies our material for your own commercial use.
3. The catalogue, prices and quotes
Product pages, minimum order quantities, lead times and any indicative pricing are a guide to what we generally supply. They are not an offer, and they can change with stock, material costs and machine availability.
A quote we send is an indication of price based on what you told us at the time. It states its own validity period; where no period is stated, a quote is valid for 30 days. Prices quoted exclude freight unless the quote says otherwise, and Australian GST is added where it applies.
4. Orders and acceptance
An order is formed when we confirm it in writing — normally an order confirmation or a sales order. Until that confirmation, a quote, a verbal indication or a sample request does not commit either side.
Please check your specification, artwork and delivery details on that confirmation. Once production of a custom item has started, changes and cancellations may not be possible without a charge for work already done.
5. Minimums and lead times
Minimum order quantities and lead times shown in the catalogue are our usual starting points. Your quote will confirm the figures that apply to your order. Lead time is measured from the point artwork, specification and payment terms are agreed, not from the first conversation.
6. Your artwork and materials
Where you supply artwork, logos or tooling, you keep owning them and you confirm you have the right to use them. You agree to hold us harmless if a claim is made about material you gave us. We will not use your artwork on anything outside your order without your permission.
7. Samples
Samples are supplied so you can check a structure, a size or a finish. Please test them with your actual product before you commit to a run — fit, seal strength, grease and liquid behaviour all depend on what you put in the pack.
8. Payment and delivery
Payment terms are those stated on your order confirmation. Delivery is arranged to the address on that confirmation, and freight charges, access requirements and any after-hours or remote surcharges are quoted separately. Risk passes to you when goods are delivered.
Tell us about damaged or short deliveries at the time of delivery, or in writing within a reasonable time after, so we can look into it with the carrier.
9. Your responsibilities
To do the job properly we need you to:
- tell us what the pack will actually hold, and how it will be heated, cooled, transported or stored
- check the artwork and the specification before production starts
- make sure the packaging you choose suits your product and your process
- keep us informed of anything that changes your order
10. Liability and your consumer rights
Nothing in these terms excludes, limits or modifies any right you may have under Australian Consumer Law. Where we can limit our liability, we do so to the extent the law allows, and our liability is limited to the price of the goods or services supplied. We are not liable for indirect losses such as lost profit, lost sales or a stopped production line.
11. Intellectual property
The text, photographs, product descriptions and layout of this website belong to us or to our suppliers. You may use them to evaluate and buy packaging from us. You may not copy, republish or resell them without our written permission.
12. Privacy
We handle the details you give us in line with our privacy policy, which forms part of these terms.
13. Changes to these terms
We may update these terms. The version that applies to an order is the one in place when that order is confirmed.
14. Governing law
These terms are governed by the law of New South Wales, Australia, and the parties submit to the courts of that state.
